These Terms of Service (“Terms”) govern your use of the Ask Dandi website and services, operated by Dandi AI LLC (“we”, “us”, or “our”). By using our website or services, you agree to these Terms. If you sign a separate service agreement or order form with us, that agreement controls if it conflicts with these Terms.
The service
Ask Dandi provides an AI-powered receptionist for service businesses: it answers calls and website chats, qualifies callers, captures lead details, and delivers summaries by text message. The service uses artificial intelligence. AI systems can make mistakes, and we do not guarantee that every call will be answered, transcribed, routed, or summarized perfectly, or that the service will produce any particular volume of leads, bookings, or revenue.
The service is not a substitute for emergency services. It is not designed to handle life-safety emergencies, and callers with an emergency should always dial 911.
Client responsibilities
If you are a client, you agree to provide accurate business information for your receptionist configuration and to keep it current. You are responsible for your own compliance with laws that apply to your business’s communications with its customers — including obtaining any consents required for call recording in your state and complying with telemarketing and text-messaging laws (such as the TCPA) for any outbound calls or messages you ask us to place on your behalf.
Pricing and billing
Current pricing is listed on our website: a one-time setup fee of $1,497 and a monthly fee of $347, which includes 500 minutes per month; additional minutes are billed at $0.35 per minute. Service begins with an initial 3-month term and continues month-to-month thereafter unless canceled. Fees for a billing period already underway are non-refundable unless we agree otherwise in writing. We may change pricing with notice before your next renewal.
Acceptable use
You may not use the service for unlawful purposes, including placing calls or sending messages without required consent, spamming, harassment, fraud, or impersonation. We may suspend or terminate service for violations of these Terms.
Intellectual property
We own the Ask Dandi software, website, templates, and branding. You own your business information and the lead data generated for your business. You grant us the right to use your data as needed to operate and improve the service, as described in our Privacy Policy.
Disclaimer of warranties
The website and services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Dandi AI LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost leads, or lost business opportunities. Our total liability for any claim arising out of the service will not exceed the fees you paid us in the three months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your business’s dealings with its customers, your violation of these Terms, or your violation of applicable law in connection with your use of the service.
Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Arkansas.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the website or services after changes take effect constitutes acceptance of the revised Terms.
